What is an Apostille?

An apostille is a certification issued by the Secretary of State that verifies the authenticity of a public document so it can be used in another country that is a member of the Hague Apostille Convention. Common documents that require apostilles include birth certificates, marriage certificates, diplomas, and notarized documents.

What is the difference between a State Apostille and Federal Authentication?
A State Apostille is issued by the Secretary of State for documents originating at the state level (such as birth certificates, marriage certificates, and notarized documents).
 
A Federal Authentication is issued by the U.S. Department of State for federal documents such as:
  • FBI Background Checks
  • Certificates of Naturalization
  • Federal court documents
  • Documents issued by federal agencies
Federal authentication is typically required for countries not part of the Hague Apostille Convention.
How long does the Apostille process take?
Processing time depends on the type of document and the issuing authority.
 
Typical timelines:
  • Illinois State Apostille: Same-day or 1–2 business days
All other states 7-10 business days 
 
  • Federal Authentication: 3–4 weeks depending on the U.S. Department of State processing times
  • Document Retrieval: Up to 10 business days depending on the issuing office

Do my documents need to be notarized before getting an apostille?
Some documents must be notarized before they can receive an apostille. Examples include:
  • Affidavits
  • Power of Attorney
  • Copies of passports
  • Educational documents
However, vital records such as birth and marriage certificates must be certified copies issued by the county or state, not notarized copies.
Do my documents need to be translated before apostille or authentication?
If your documents will be used in a country where another language is required, certified translation may be necessary. In most cases:
  • The original document is apostilled or authenticated first.
  • The document is then translated by a certified translator.
  • A certificate of translation accuracy may also be notarized and apostilled if required by the receiving country.
What are the differences between Hague Convention countries and non-Hague Convention countries?

In 1961, many countries joined together to create a simplified method of authenticating documents for universal recognition. Members of the conference, referred to as the Hague Convention adopted a document referred to as an Apostille that would be recognized by all member countries.

There are two categories of destination countries: those that are part of the Hague Convention and those that are not. Apostilles can exclusively be obtained for countries within the Hague Convention. If your intended destination falls outside the scope of the Hague Convention, it is categorized as a non-Hague Country. In such cases, authentication is required through the U.S. Department of Justice in Washington D.C. and/or embassy legalization for the specific country.
